These Terms of Service ("Terms") are a legally binding agreement between you and Zunii. They govern your access to and use of the Zunii mobile application. By creating an account or using the Service, you agree to these Terms in full. If you do not agree, do not use Zunii.
Throughout these Terms, the following definitions apply:
2.1 These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Abhishek Olkha ("Zunii," "we," "us," or "our"), governing your use of the Zunii mobile application (the "App").
2.2 By creating an account, accessing, or using the App, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines, all of which are incorporated herein by reference. If you do not agree to any provision of these Terms, you must immediately cease all use of the Service and delete your Account.
2.3 We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms within the App and updating the "Effective Date" above. If we make changes that materially affect your rights, we will provide advance notice through in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree with updated Terms, you must stop using the App and delete your account.
2.4 By using the Service, you consent to receive communications from us electronically, including notices, agreements, and disclosures. You agree that all agreements, notices, and communications we provide electronically satisfy any legal requirement that such communications be in writing.
You must be at least 18 years of age to create an Account or use any part of the Service. By using Zunii, you represent and warrant that you meet this age requirement. We actively monitor for and remove Accounts of Users who appear to be under 18.
3.1 Age Requirement. The Service is intended solely for Users who are 18 years of age or older. By creating an Account, you represent and warrant that you are at least 18 years old. We employ age verification measures during registration, including date of birth verification. We reserve the right to require additional age verification at any time, including but not limited to identity document verification. In countries where a higher or different minimum age applies, that higher age controls:

3.2 Legal Capacity. You represent that you have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. If you are using the Service on behalf of an entity, you represent and warrant that you have authority to bind that entity to these Terms.
3.3 Compliance with Laws. You represent that your use of the Service does not violate any applicable law or regulation in your jurisdiction.

4.2 Accurate Information. You agree to provide truthful, accurate, current, and complete information during registration and to maintain and update such information to keep it accurate. Providing false, misleading, or outdated information constitutes a violation of these Terms and may result in immediate termination of your Account.
4.3 Account Security. You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to:
4.4 Single Account Policy. Each individual may maintain only one Account. Creating multiple Accounts โ including to circumvent enforcement actions, manipulate the matching system, or for any other purpose โ is strictly prohibited and will result in permanent suspension of all associated Accounts.

4.6 No Transfer. Your Account is personal to you and may not be transferred, sold, or assigned to any other person or entity.
5.1 Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service on a personal device that you own or control, solely for your personal, non-commercial use.

ZUNII DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS, IDENTITY VERIFICATION BEYOND BASIC REGISTRATION, OR SCREENING OF USERS. YOU ARE SOLELY RESPONSIBLE FOR YOUR SAFETY WHEN INTERACTING WITH OTHER USERS. WE STRONGLY RECOMMEND EXERCISING CAUTION, GOOD JUDGMENT, AND APPROPRIATE SAFETY PRECAUTIONS IN ALL INTERACTIONS, AND NEVER SHARING PERSONAL CONTACT INFORMATION (PHONE NUMBER, HOME ADDRESS, FINANCIAL INFORMATION) WITH STRANGERS.
The following will result in immediate and permanent Account termination without prior warning. We may also report violations to law enforcement and relevant authorities.
We report all identified CSAM and child exploitation material to the National Center for Missing & Exploited Children (NCMEC) as required under 18 U.S.C. ยง 2258A, and to applicable law enforcement agencies worldwide.

Content that promotes hatred, violence, or discrimination against individuals or groups based on protected characteristics is prohibited, including but not limited to:
8.1 Matching System. Zunii connects Users randomly based on selected filters (age, gender, country). We do not guarantee the availability, frequency, or quality of matches. We are not responsible for the behaviour, Content, or actions of other Users. All matching is subject to availability and our safety systems.
8.3 Anonymity Features. To protect User privacy:
8.4 Screenshot Detection. On supported iOS and Android devices, the Service includes screenshot detection. When a screenshot is detected during an active chat, both participants are notified. This feature may not function on all devices, operating systems, or browsers and is provided on an "as-is" basis without warranty of completeness or reliability.
8.5 Connections. If both Users mutually agree during an extended chat, they may add each other as Connections. Connection chats do not have time limits and permit image sharing. You can optionally share your full name or profile picture with a Connection using the in-app sharing feature.
8.6 Image Sharing. Image sharing is available only in Connection chats. All shared images:
8.7 New Account Restrictions. To prevent abuse, Accounts less than 24 hours old are subject to limited functionality, including restrictions on image sharing.
8.8 Service Availability. We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice.
Zunii offers optional premium subscriptions ("Zunii Premium") on a monthly or yearly basis, providing additional features including priority matching, increased connection limits, unlimited match filters, and an ad-free experience. By subscribing, you agree:

Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods, except as set forth below or as required by applicable law.
For subscribers residing in Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, and Wisconsin:
YOU, THE BUYER, MAY CANCEL YOUR SUBSCRIPTION, WITHOUT PENALTY OR OBLIGATION, AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY FOLLOWING THE DATE YOU SUBSCRIBED (EXCLUDING SUNDAYS AND HOLIDAYS). IN THE EVENT THAT YOU DIE BEFORE THE END OF YOUR SUBSCRIPTION PERIOD, YOUR ESTATE SHALL BE ENTITLED TO A REFUND OF THAT PORTION OF ANY PAYMENT YOU HAD MADE FOR YOUR SUBSCRIPTION WHICH IS ALLOCABLE TO THE PERIOD AFTER YOUR DEATH. IN THE EVENT THAT YOU BECOME DISABLED (SUCH THAT YOU ARE UNABLE TO USE ZUNII) BEFORE THE END OF YOUR SUBSCRIPTION PERIOD, YOU SHALL BE ENTITLED TO A REFUND OF THAT PORTION OF ANY PAYMENT YOU HAD MADE FOR YOUR SUBSCRIPTION WHICH IS ALLOCABLE TO THE PERIOD AFTER YOUR DISABILITY BY PROVIDING THE COMPANY NOTICE AT support@zunii.app.
Subscribers who purchase weekly subscriptions are entitled to a refund of the price of the subscription (minus the value of any portion of the subscription used at the date the refund is requested) if requested within the first 6 days after the subscription starts.
Subscribers who purchase monthly or longer subscriptions are entitled to a refund of the price of the subscription (minus the value of any portion of the subscription used at the date the refund is requested) if requested within the first 14 days after the subscription starts.
There are no refunds for subscription renewals. Suspended or blocked members are not entitled to refunds.

Credits earned through rewarded ads or included with Premium can be used for:
Credits have no monetary value, cannot be transferred, cannot be exchanged for cash, and expire upon Account deletion. Credits are not refundable.
To protect your privacy, you may set an auto-delete period of 30, 60, or 90 days (default: 90 days). If you do not open the App for your chosen period, your Account and all associated data will be permanently deleted. You will receive a warning as you approach the danger zone (25% of your chosen period remaining). Opening the App resets the timer.
Connections automatically expire after 90 days of inactivity (no messages sent by either party). You will receive a warning when a Connection has 20 or fewer days remaining. Sending a message resets the 90-day timer. Expired connections and all associated chat data are permanently deleted.
10.1 Reporting. You can report any User or content that violates these Terms using the in-app Report button, available on every chat screen and user profile. Report categories include:

10.4 Enforcement Actions. Based on the nature, severity, and frequency of violations, we may take one or more of the following actions at our sole discretion:
Users who accumulate 5 or more verified reports will have their Accounts permanently locked.
10.5 Blocking. You may block any User at any time. Blocked Users cannot match with you, contact you through the Service, or view your profile. Blocked Users are not notified that they have been blocked.
10.6 New Account Restrictions. To prevent abuse, Accounts less than 24 hours old are subject to limited functionality, including restrictions on image sharing.
10.7 Confidentiality of Reports. All reports are confidential. The reported User will not be informed of the identity of the reporting User.
10.8 False Reports. Submitting false, frivolous, or malicious reports is a violation of these Terms and may result in enforcement action against the reporting User.
10.9 Content Scanning. We do not conduct proactive or automated scanning of message content. Message content is reviewed only when a report is filed by a User through our in-app reporting system. The only exception is that we may use automated hash-matching technology to detect known Child Sexual Abuse Material (CSAM), which we are required to report under applicable law.
10.10 Liability. We are not liable for content posted by other Users. We are committed to acting on reports promptly and maintaining a safe environment.
You retain all ownership rights in User Content you create and share through the Service. Zunii does not claim ownership of your User Content.
By submitting, posting, or transmitting User Content through the Service, you grant Zunii a worldwide, non-exclusive, royalty-free licence to use, reproduce, transmit, and display such User Content solely as necessary to operate and provide the Service (including delivering messages, displaying profiles to matched users, and performing content moderation). This licence terminates when you delete your User Content or your Account, except as required for legal compliance or pending safety investigations.
You represent and warrant that:
We have no obligation to monitor, review, or edit User Content. However, we reserve the right to review, remove, or disable access to any User Content at our sole discretion, for any reason, without notice.
The Service, including all software, code, design, text, graphics, logos, icons, images, audio, video, data compilations, and all other elements (collectively, "Zunii Materials"), are owned by or licensed to Zunii and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. The Zunii name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Zunii. You may not use such marks without our prior written permission. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on our content without our prior written consent.
If you provide us with feedback, suggestions, ideas, or recommendations regarding the Service ("Feedback"), you assign to us all rights in such Feedback and agree that we may use, reproduce, modify, and distribute such Feedback without restriction, obligation, or compensation to you.
We respect the intellectual property rights of others. If you believe that any Content available through the Service infringes your copyright, please submit a notice to admin@zunii.app with the following information:
We will terminate the Accounts of Users who are determined to be repeat infringers of third-party copyrights.
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

Account deletion is permanent and irreversible. When you delete your Account:
Data is deleted within 30 days, except where retention is required by law.
We may suspend or terminate your Account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
Accounts that are suspended or in a cooldown period may have restricted self-service deletion within the App. However, you may still exercise your legal right to data deletion at any time by contacting privacy@zunii.app. We may retain limited data where legally required (e.g., for ongoing investigations, legal obligations, or to enforce our Terms), but we will inform you of any such retention and its legal basis. Suspended accounts that are not appealed are automatically deleted after 90 days.
Upon termination or suspension:
If you believe your Account was suspended or terminated in error, you may submit an appeal to appeals@zunii.app. We will review appeals and respond within 30 days. Appeals are not available for zero-tolerance violations as described in Section 7.

14.1 THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZUNII DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
14.2 WITHOUT LIMITING THE FOREGOING, ZUNII DOES NOT WARRANT THAT:
14.3 User Interactions. ZUNII IS NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SERVICE. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR IDENTITY VERIFICATION OF USERS BEYOND BASIC REGISTRATION. YOU AGREE TO EXERCISE CAUTION, GOOD JUDGMENT, AND APPROPRIATE SAFETY PRECAUTIONS WHEN INTERACTING WITH OTHER USERS.
14.4 Third-Party Services. THE SERVICE MAY CONTAIN LINKS TO OR INTEGRATIONS WITH THIRD-PARTY WEBSITES, SERVICES, OR CONTENT. ZUNII DOES NOT ENDORSE, CONTROL, OR ASSUME RESPONSIBILITY FOR ANY THIRD-PARTY SERVICES, AND YOUR USE OF SUCH SERVICES IS AT YOUR OWN RISK.
14.5 No Professional Advice. NOTHING IN THE SERVICE CONSTITUTES PROFESSIONAL, LEGAL, MEDICAL, FINANCIAL, OR OTHER ADVICE. YOU SHOULD CONSULT APPROPRIATE PROFESSIONALS BEFORE MAKING DECISIONS BASED ON INFORMATION OBTAINED THROUGH THE SERVICE.
15.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZUNII, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
15.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO ZUNII IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).
15.3 NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION. THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
You agree to defend, indemnify, and hold harmless Zunii, Abhishek Olkha, and their respective officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
This indemnification obligation will survive the termination or expiration of these Terms and your use of the Service.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO A JURY TRIAL. IT ALSO CONTAINS A CLASS ACTION WAIVER.
17.1 Governing Law. These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
17.2 Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve the dispute informally by contacting us at support@zunii.app. We will attempt to resolve the dispute informally within 60 days. If the dispute is not resolved within 60 days, either party may proceed with formal dispute resolution as set forth below.
17.3 Binding Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that is not resolved informally pursuant to Section 17.2 shall be resolved by binding arbitration administered in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be Jhunjhunu, Rajasthan, India. For users residing outside India, the arbitration may be conducted remotely via video conference. The language of the arbitration shall be English. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
17.4 Class Action Waiver. YOU AND ZUNII AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, MULTI-PARTY, OR REPRESENTATIVE PROCEEDING. Unless both you and Zunii agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class, consolidated, multi-party, or representative proceeding.
17.5 Exceptions. Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidentiality obligations.
17.6 Consumer Rights. If you are a consumer based in the EU, UK, or any jurisdiction with mandatory consumer protection laws, nothing in this section limits your statutory rights, including any mandatory right of withdrawal or remedy under local law. EU and UK consumers retain the right to bring claims in the courts of their country of residence, and this arbitration clause does not override mandatory consumer protection laws.
17.7 Opt-Out. You may opt out of this arbitration agreement by sending written notice to admin@zunii.app within 30 days of first accepting these Terms. Your notice must include your name, Account information, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, you agree to the exclusive jurisdiction of the courts located in Jhunjhunu, Rajasthan, India (subject to Section 17.6 for EU/UK consumers). If you previously agreed to a version of these Terms containing this arbitration agreement and did not opt out, future updates to these Terms do not provide a new opportunity to opt out of arbitration.
Australian users must be at least 16 years old. By creating an account, you confirm you are 16 or older. We employ age verification measures during registration and reserve the right to require additional verification at any time. We are required by Australian law to take reasonable steps to prevent users under 16 from holding accounts. Nothing in these Terms excludes, restricts, or modifies consumer guarantees under the Australian Consumer Law.
If you are an EU or UK consumer, nothing in these Terms limits your statutory consumer rights, including mandatory withdrawal rights. You retain the right to bring claims in the courts of your country of residence.
To comply with the UK Online Safety Act 2023, we operate: (a) an in-app report button on every conversation; (b) a user blocking function; (c) content moderation processes to detect and remove illegal content as defined under UK law, including CSAM, terrorism content, and content facilitating serious crime.
We comply with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. As a social media intermediary operating in India: we publish these Terms and Community Guidelines prominently; we provide an in-app grievance mechanism; we will remove unlawful content upon receiving actual knowledge through a court order or government notification; for CSAM or content threatening national security, we will act within 24 hours of receiving notice. See our Privacy Policy for Grievance Officer details.
In addition to the Community Guidelines, users in these countries agree that the following additional standards apply due to local law:
We reserve the right to restrict access to specific features or content for users in these regions to comply with local law. We comply with lawful government content removal orders.
Any content that constitutes Child Sexual Abuse Material (CSAM) will be immediately removed and reported to the National Center for Missing and Exploited Children (NCMEC) CyberTipline as required under 18 U.S.C. ยง 2258A. We will cooperate fully with law enforcement investigations.
19.1 Entire Agreement. These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Zunii regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
19.2 Severability. If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
19.3 No Waiver. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Zunii.
19.4 Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms or any rights or obligations hereunder without restriction, including to any affiliate or in connection with a merger, acquisition, corporate reorganisation, or sale of all or substantially all of our assets. In the event of such assignment, we will notify you and your data will continue to be protected under substantially similar privacy terms, consistent with our Privacy Policy.
19.5 Force Majeure. We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, internet disruption, strikes, or shortages of transportation, facilities, fuel, energy, labour, or materials.
19.6 Notices. We may provide notices to you through the Service, via email to the address associated with your Account, or by other reasonable means. You may provide notices to us by emailing admin@zunii.app. Notice shall be deemed given upon receipt.
19.7 Relationship of the Parties. Nothing in these Terms shall be construed as creating a partnership, joint venture, employment, or agency relationship between you and Zunii.
19.8 Export Compliance. You agree to comply with all applicable export and re-export control laws and regulations, and you will not directly or indirectly export, re-export, or transfer the Service to any country, entity, or person prohibited by such laws.
19.9 Headings. The section headings in these Terms are for convenience only and have no legal or contractual effect.
19.10 Survival. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, limitations of liability, indemnification obligations, and dispute resolution provisions.
